Terms of Service

1. Acceptance

By creating an account or using FabricaPosts you confirm you have read and accepted these Terms of Service and our Privacy Policy. If you do not agree with any clause, do not use the platform.

2. Service description

FabricaPosts is a SaaS platform that generates Instagram carousels using artificial intelligence and lets you publish directly to your Instagram Business/Creator profile via OAuth authorization through the Instagram API.

3. Account

  • You must have a valid email address
  • You are responsible for keeping your access credentials confidential and for all actions performed under your account
  • One account per individual or legal entity
  • Minimum age: 18 (or 13+ with parental authorization)

4. Plans and payment

  • Free: monthly generation cap as shown in the app
  • Pro and Agency: paid plans with expanded quotas, as listed in /pricing (forthcoming)
  • Monthly recurring billing; you may cancel at any time and retain paid access until the end of the already-billed cycle
  • No pro-rata refund for partial cycles, except where required by law

5. User content

  • You retain full ownership of all content (briefs, carousels, images, brand assets) generated through the platform
  • You grant us a non-exclusive, worldwide, revocable (upon account deletion) license to process, store, and display that content solely to provide the service
  • You may not generate or publish content that is: (i) illegal, fraudulent, or defamatory; (ii) infringing on third-party rights (copyright, trademark, likeness); (iii) in violation of destination platform policies, in particular the Instagram Community Guidelines and Meta Platform Developer Terms

6. Instagram integration

  • You authorize FabricaPosts to publish to your Instagram profile only when you manually confirm in the publish dialog inside the editor
  • You may revoke the connection at any time in Settings → Disconnect; we delete the stored token at that moment
  • You are solely responsible for the published content. Bans, suspensions, or penalties imposed by Instagram/Meta are your responsibility
  • We do not guarantee continuous availability of the Instagram API. Should Meta change or deprecate endpoints, we will make reasonable efforts to adapt the platform but no contractual SLA covers this

7. Acceptable use

You may not:

  • Reverse-engineer, scrape, or run non-human automation against the API or UI
  • Share access credentials
  • Operate multiple accounts to bypass plan limits (free-tier farming)
  • Use the platform for spam, deceptive content, or impersonation

8. Availability

  • Best-effort 99% monthly uptime measured at the web tier
  • No contractual SLA on uptime or job processing time on the Free plan
  • Planned maintenance windows are announced 24h+ in advance

9. Limitation of liability

The service is provided "AS IS", without warranty of fitness for a particular purpose. Our total liability, for any cause, is limited to the amount you actually paid in the twelve (12) months preceding the triggering event. For Free plan users, liability shall not exceed the equivalent of one (1) month of the most basic paid plan in effect at the time of the event. We are not liable for: lost profits; indirect or consequential damages; AI-generated content that infringes third-party rights (you are responsible for review before publishing).

Restrictions imposed by Meta/Instagram are outside our control. Meta may, at its sole discretion, restrict, suspend, or terminate access to any account — including reach reduction, ad limitations, and bans — regardless of FabricaPosts usage. We have no control over Meta's moderation policies, detection algorithms, or review decisions, and therefore are not liable for any penalty Meta applies to your Instagram account.

10. Termination

  • You may terminate your account at any time
  • We may suspend or terminate accounts that violate these Terms, with prior notice when possible and except in cases of fraud, spam, or court order
  • Surviving clauses after termination: privacy, limitation of liability, and venue

11. Changes to the Terms

We reserve the right to amend these Terms. Material changes will be communicated by email and in-app banner with 30 days' notice. Continued use after the effective date constitutes acceptance.

12. Governing law and venue

These Terms are governed by Brazilian law. The forum of Laguna - SC, Brazil, is hereby elected to settle any dispute arising from these Terms, to the exclusion of any other, however privileged.

13. Non-affiliation with third-party platforms

FabricaPosts is not affiliated with, associated with, authorized by, endorsed by, or in any way officially connected to Meta Platforms, Inc., Instagram, Facebook, or any of their subsidiaries or affiliates. The names Instagram, Meta, Facebook, and their respective logos are trademarks of their respective owners. FabricaPosts uses the official Instagram API under the Meta Platform Developer Terms with permissions approved by Meta.

14. Artificial Intelligence

  • We use AI models (Anthropic Claude, Replicate) to generate carousels, copy, and images from the instructions and brand identity you provide
  • AI-generated content is delivered as a suggestion; you are ultimately responsible for reviewing and approving it before publishing to any platform
  • We do not guarantee the originality, accuracy, or suitability of AI-generated content, nor that it does not infringe third-party rights
  • Your data obtained via the Instagram API is NOT used to train AI models (whether our own or third-party). Data is processed by AI providers only to generate the requested response, as detailed in our Privacy Policy

15. Indemnification

You agree to indemnify and hold harmless FabricaPosts, its partners, employees, and contractors from any claims, losses, damages, costs, and expenses (including reasonable attorneys' fees) arising from: (i) your breach of these Terms; (ii) content published by you or through your account; (iii) infringement of third-party rights (copyright, trademark, likeness, privacy); (iv) misuse of credentials by third parties you authorized.
